Court stops Ogun governor from demolishing Senator Gbenga Daniel’s house, hotels

An Ogun State High Court on Tuesday issued an ex parte order barring Governor Dapo Abiodun or any official from the state government from tampering or demolishing the Asoludero Court, Sagamu GRA private residence of former governor of the state, Gbenga Daniel.

The order also covered the Conference Hotels Limited and the annex also owned by the former governor, reports The PUNCH.

Justice O.S Oloyede gave the order following motion for ex-parte order for interim injunction filed on behalf of Daniel and his wife, Yeye Olufunke Daniel by their counsel, A M Kotoye, SAN against Abiodun, the Attorney General of Ogun State, Ogun State Planning and Development Permit and the Commissioner for Physical Planning and Urban Development.

According to the Certified True Copy of the order signed by W T Ogundele, the Principal Registrar and made available to journalists, Kotoye had among others things demanded for an exparte order restraining the defendants/respondents and their agents from demolishing or in any way or manner tampering with the property known as Asoludero Court, the Conference Hotels as well as the annexe pending the determination of the motion on notice filed before the court.

While giving his order, Justice Oloyede said, “Having read the affidavit in support and the affidavit of urgency, I am satisfied that this court needed to take immediate steps to intervene in this case.

“Consequently, I hereby issue an exparte interim order of this honourable court restraining the defendants/respondents and their agents, allies, proxies, assigns, cronies, servants, etc and any other person(s), howsoever described, either claiming through them or acting on their behalf, in whatsoever as manner, upon their authority/ instructions, from demolishing or in any way or manner tampering with the property known as Asoludero Court, situate, lying and being at Block 1, Plots 7 and 8 and of Block XXXVIII, Plot 1 and 12, within the amended part of the Government Reservation Area, Sagamu, now known Awolowo Avenue, Sagamu, measuring approximately, 1,659 hectares, more particularly plan No. SA. 160 (OG) attached to the old Certificate of Occupancy No 024698 dated the 21st April, 2005, later replaced by a new computerised Certificate of Occupancy No. LUD3/LR2693 dated 20th January, giving 2010 and/or to the effect defendants/respondents’ quit notice dated 8th August, 2025, pending the hearing and determination of the motion on notice herein filed.

“I equally issue an order of interim injunction restraining the defendants/respondents and their agents, allies, proxies, assigns, cronies, servants, etc and any other person(s), howsoever described, either claiming through them or acting on their behalf, in whatsoever manner, upon their authority/instructions, from further trespassing or any way disturbing the claimants/applicants, from enjoying the quiet possession of the property known as Asoludero Court, situate, lying and being at Block 1, Plots 7 and 8 and of Block XXXVIII, Plot 1 and 12, within the amended part of the Government Reservation Area, Sagamu, now known as Awolowo Avenue, Sagamu, measuring approximately, 1,659 hectares, more particularly plan No. SA. 160 (OG) attached to the old Certificate of Occupancy No 024698 dated 21st April, 2005, later replaced by a new computerized Certificate of Occupancy No. LUD3/LR2693 dated 20th January, 2010 and/or giving effect to the Defendants/Respondents’ Quit Notice dated 8th August, 2025, pending the hearing and determination of the Motion on Notice herein filed.”

The suit has been adjourned till August 19, 2025 for the hearing of the application for interlocutory injunction.

It will be recalled that Daniel on Saturday accused Abiodun of ordering the demolition of his Sagamu private residence, The Asoludero Court, Conference Hotels Limited as well as the hotel annexe in Sagamu all owned by the former governor.

The former governor in a statement signed by his media aide, Oliyide said that the order of the governor was conveyed in notices of contravention, quit and threat of demolition within the next three days which was pasted on the properties on Friday, August 8 at about 4pm.

Daniel described the allegation leveled against him as laughable and one that is deeply rooted in a thuggish and political vindictiveness at its highest shameful level.

The Commissioner for Urban Development and Physical Planning, Tpl Tunji Odunlami has however said that the contravention notice was not to target any individual but a routine government land auditing of its GRAs which is in line with its urban renewal project.

Odunlami, while addressing journalists on Monday, had said that what everyone served the contravention notice in the GRA ought to do including Daniel currently representing Ogun East at the Senate was to come forward with their necessary documents for verification by the government.

He insisted that the audit exercise was not to tarnish anybody’s image as it will also be carried out in the GRAs owned by the government across the state.
